you would still be short term on the original sale. the second would be long term once sold.

it would be short term for the gains from your initial investment you sold and put in the other one, then you would get longterm on it if held over a year. The percentage rate for longterm gains changes after 2010 unless obama extends the 15% that bush passed. I think it goes back to 28% , not sure what rate, but it will go up
