Even as we speak,several large law firms are putting together the machinery to sue Mellon Bank in a class action for breach of their fiduciary duty.I am in my second year of law school,and have talked to several business/corporate B/K lawyers here in the mid-south-I can't give any names or specifics(I want to get my law license at SOME point)but look at my profile,past posts-I try not to pump,and never post erroneous BS if I can help it. ACDU has dumpped their position over the last few weeks-now we know why the PPS has eroded(or at least have a reasonable basis for speculation).As trustee,Mellon Bank had a fiduciary duty to file for and seek enforcement of the guarantee-they were supposed to do this for all holders of Cap Trust shares-they failed,and will be held accountable.Yes,the lawyers will probably get between 30%-50% of any settlement,but we WILL get alot more than the paltry 20 cents we are offered now. As I have said in multiple posts,I am prepared nto hold on to this for years,and will average down if it drops. GLTA,and have a strong heart.I know it is hard to believe in the legal system,but never forget one thing about lawyers-for every asshole out there trying to screw you out of what is yours,there is his advisarial counterpart fighting just as dirty to keep your rights intact. Therefore, ACDU made the decision to sell its Capital Trust shares on the open market at a loss of approximately 10% from its original investment. The company liquidated all of its Capital Trust shares on March 29 and March 30, 2010, and realized approximately $72,000.00 in cash.
