On Tuesday, Taricani's attorneys responded to a judge's order that both sides address the question at sentencing of whether or not Taricani should pay any or all the government's and court costs incurred since October of last year.
Taricani's attorneys assert that previous court findings say costs incurred while collecting evidence may not be part of any restitution. They contend that if the court does order payment, it should be in lieu of prison time.
The response of the special prosecutor in the case, Marc Desisto, was made public Wednesday. He claims the court and federal government are victims of Taricani's actions. He contends that by law the court can impose restitution for victims. Desisto's filing leaves the amount up to the court.
