No, because it's based on the upslope, which is legitamte since it's had 3 touches. I also made sure my downside target correlated with the upslope creating a 90 degree angle, as you can see in the chart with the vertical blue lines I drew between the head, the shoulder, and the proposed shoulder.

Also, if you look at the chart closer, you'll notice a H & S pattern that has already taken place, with the shoulders being around the top channel, and the head being the current head, a break down of this foresaw the eventual bottom to 1,750. So, I think that adds to the credibility of this current formation...
