**No, doubtful. For a long time I've have thought that settlement would coincide with the end of exclusivity. That was before we learned the truth about Weil, and the fact that they are basically fighting against us at all costs. I thought they would pressure JPM/FDIC to settle through Discovery, etc.

Obviously, they were just trying to make the sweetest deal possible for everyone but equity. Fortunately, the law of this country, as our good friend Diamond says, is one our side and the UST stepped in to protect us.

Whatever settlement they were concocting is done and cooked. The EC will never approve it unless it includes equity. The FDIC and JPM are going to have to take care of preferred stock and throw some dollars at commons to make this go away for good.

Weil's filiing yesterday was another attempt to derail the EC, showing that they are desperate because Marcia G. probably promised Jamie over phone sex that this would all go away painlessly.

Oops.

I look forward to the EC's response to this BS. But settlement? Now it comes down to how hard JPM and FDIC will try to avoid paying equity. IMO, this goes right up to the jury trial which is something that Weil did not want. They expected this to be over, and playing golf and laughing with JPM this Spring imo.

So my March settlement timeframe is off the table. This is just my opinion, and I think we're in for a longer road here. Could be another year before a jury trial gets going. The 'good' news is that there are events that will cause rises in all classes coming soon imo. So while I don't believe a settlement is imminent, I do feel that we could see some rising prices if court hearings continue to go our way.

It also gives more time for the media to pick up this story. Anyway, we'll get there, but even Bopfan pointed out that with the approved EC it's back to the drawing board. The EC have a number, JPM/FDIC have numbers, and it's all about what number everyone finally agrees to.

Of course, I'll still be your # 1 poster here on the board. :)
