Perhaps SPNG felt that revealing the truth regarding the OS would cost them more money on the market than the increased DE tax burden. Especially if they have no intention of paying the tax bill anyway. And, it is my opinion that do not have any intention of paying the DE bill now or in the future.
I'm waiting for someone to tell me what we're missing.
