The parties probably did some 'private' apologizing to the Court before submitting the motion, so it will probably be granted.

1. The deadline to file pretrial motions is extended until December 28, 2009.

2. The parties will advise the Court by December 28, 2009 as to the staus of this matter.

probably will.....why risk allowing the defense a dismissal "loophole" later down the line????.....give them every chance to prepare, so no excuses later, IMO.....
