I don't understand your first question. From the message alone (which at the time seemed to be 'official') it seemed there was nothing of interest, so was quickly dismissed. And nothing has changed that AFAIK.

The point which I think you've missed is that this was represented as a communication from the company itself, not a non-employee.

If it's more likely in your mind that it's a company of sixth-graders, go for it, believe that.

If a company is just interested in acquiring the IP, your conclusion might be true. If they want to buy a company, culture is a critical consideration on early due diligence. That assessment includes shareholder quality and the ability of the company to own its own message. If I was trying to position my company for an acquisition by Google, it would be very bad news to find one of my investors had begun the process with a letter of infringement.

Also, go back and look at the tense of the statements you are trying to compare. One is past, one is present.
