I see your point Donna but again we as investers do not know exactly what documents they seek. If you have an idea as to what they have subpoenaed I would like to hear what it is, I can only assume the documents stated in my prior post to you. At this stage of the investigation I can also assume that they have had those documents in front of them and are on to different issues within the investigation. It has been 7 weeks since the formal began and for all we do know, the investigation could be over.
Earlier in the day I reposted some excellent DD from back in june regarding "gagging" a T/A. http://investorshub.advfn.com/boards/read_msg.aspx?message_id=43581052 It was information that I was completely unaware of and found it to be very interesting in ragards to the SPNG NSS claim. When looking at the date that they petitioned for non disclosing of the share structure I realized that it was back in the time when NSS became a problem for this company. It has reaffirmed what I had already strongly suspected - the naked positions do exist and in great numbers.
I know this seemingly has no direct correlation with the non disclosure of finacial information but my gut is telling me that WE are not the parties the company wishes to hide financials from at this time.
Its a good guy bad guy thing and difficult to distinguish who is who
