My guess, SEC has been on the scent since Pensley's letter to the SEC back in March. I know of a severely burned shareholder that went to the SEC around the same time. This burned shareholder had a ton of the "back door" chatter documented among some of our favorite posters out there.
IMHO, SEC has been watching for at least 6 months!
