It would appear that additional (on top of the 1B already diluted from 5.3B to 6.3B) dilution would have to take place to pay the suit, if lost...

so brian knew because we're at about 5.7 bil. he capped at 7 bil. and law suit for 400,000 is 1 bil. puts us near 7 bil. cap makes sense.
