In this economy, law firms are loathe to press for something as onerous as a percentage fee. I'm thinking this would be done as standard rate hourly billing.
A contract matter like this is actually not that difficult to litigate, and a percentage take seems disproportionate to me, unless it was like 5, 10 percent at most.
