The date of record is the date the merger takes effect( or the day after). Therefore, if it already happened the merger would have happened.
IIRC they also have to list the date of record so many days in advance. That is how it worked when my other stocks split or paid a dividend. I believe it will be listed on otc:bb's web site.
the record date to be determined is exactly what it is. Its either in the future or in the past and the commonsense approach is to actually wait for its announcement. Rarily have I seen such a notice go out and then the record date set days or weeks in the past of the original notice. Not one time have I seen that

Everybody that owns shares of BEHL the day before the merger with the new ticker will be given one share of the new company. You can't block out anybody from getting the shares because those new shares are going to be the O/S of the new company..so they all have to be changed. The date of the new change is going to be announced.
