As we agreed during our telephone conversation today, Mr. Mangiapane will voluntarily cooperate and does not need to make arrangements to provide grand jury testimony on November 13, 2008. Instead, he will provide a proffer in California sometime in November or early December, after which time it will be determined whether he will need to travel to Delaware to provide the grand jury testimony in mid-December 2008. As we discussed I will need to attend the informal interview, and I am already scheduled to go to trial on November 20th, 2008. If that matter is not resolved or continued, we will not be available for the informal meeting in Los Angeles until the week of December 1, or 8th, 2008. I should know by the end of next week whether that matter will go forward on November 20th, 2008, and will call yo when I do.

In the meantime, please feel free to contact me when you are ready to make further arrangements. Thank you so much for your continued cooperation,
