NY was a question as to whether the town council had acted within its powers or their decision was ultra vires. It was NOT about whether there should or shouldn't be a plant there- it was about whether the council had undertaken the correct produre and full due diligence to reach the decision they reached

I think this is the 4th time I have explained this to you.

Be fair, Jon, that is the New York State Court's ruling. The federal court case (Suing for $10M plus interest)is still ongoing.
