They certainly were busy doing a few things prior to filing BK...this was received on 11/25/2008 from the department chair at VCU that took over the 5-HMF project from Dr Abraham...

bolded by me

I "inherited" the raid grant from don abraham. don established a use patent on 5HMF for sickle cell disease. the raid grant is to provide clinical grade 5HMF for clinical trials. don's original and the current plan is for the clinical trials to be supported and pursued through an sbri. accordingly, the use patent was licensed to the successful sbri applicant, xechem.

i believe nih has delivered on its promise to make available some quantity of 5hmf appropriate for the initiation of clinical trials.

xechem has experienced unanticipated problems in launching the clinical trials. after perhaps two years of no progress, some progress has been made in the past few months. specifically, xechem has held a pre-ind meeting with the fda concerning the nature of those trials. i believe that xechem is working on an ind filing.
...

we all know what happened next and where the $$ from the sale of the 5-HMF license to AesRx went...

sounds like more doubletalk to me. Let's see they couldn't/wouldn't operate the business when they had the license and the Nigerian government support but will be able to magically do so post BK after selling off and losing any remaining assets and pissing off the Nigerian government. They have had their chance to show what they are capable of and that is to lie and pay themselves. If they would have spent as much time, energy and money into fixing whatever production problems they were having as they did serving their own interests they would most likely be selling Nicosan on a large scale today if they had the competence to do so.
