Legal Proceedings

We are involved in various legal actions arising in the normal course of business, both as claimant and defendant. Although it is not possible to determine with certainty the outcome of these matters, it is the opinion of management that the eventual resolution of the following legal actions will not have a material adverse effect on our financial position or operating results. We expense professional fees associated with our legal proceedings as they are incurred according to the terms negotiated between us and the respective professional who represents our interests. We have not accrued a loss contingency in relation to any of our pending litigation.

I 1st learned of this technology in the fall of 2002 at the same time that the Pondering Primate was entering the fray as well. Since May 2003, I have been actively invested in NeoMedia with substantial holdings (substantial = anything over 10Mil. shares) and have attended numerous PWC conferences, lectures and events, as well as a number of ASM's...and I've become friends with a fair amount of people in the industry as a result. With that said and with all due respect, I do not necessairly feel compelled to tell everybody everything that I've learned over this course of time. But as I did state, I can assure you that the lawyers who respresent NeoMedia which I've posted about are working on a contingency basis - to one degree or another. Whether you accept this at face value or not is not my business, but rather yours. However, I sincerely thank you for your interest in this matter. Wish I had more to offer.
