What biotech company would pay hundreds of millions of dollars to pay for trials just to get five years exclusivity. If the innovator only gets five years exclusivity innovation would die.

That’s total BS, drbio. If a new biotech drug is innovative, it can presumably be patented. A patent affords protection from competition irrespective of the data-exclusivity period in FoB legislation.
