New 52-Week Highs : The new high list is fairly light again today. Of note, Pixar (PIXR 78.10 +0.16) is at new high and has had a great August run in anticipation of the release of co's sixth film, The Incredibles, in November. REITs are dominating the new high list as investors sought safety, especially this morning. Financials are also well represented. Sectors include REITs (ALX, AML, BRE, CNT, CUZ, EQR, ESS, KRC, SMT, VNO), Financials (ALAB, BAC, BOH, CBSS, FRC, RF, RBNC), Transport (BNI, TOPT).

Retail index slides into red at close ($RLX)

CHICAGO (CBS.MW) -- The S&P Retail Index ($RLX) finished Tuesday's session slightly off at 388.92. Winn-Dixie (WIN) led the march south, losing 72 cents, or 14.7 percent, to $4.17. Albertsons (ABS) lost 52 cents, or 2.1 percent, to $24.58, after reporting disappointing quarterly results that were still loaded with charges related to the five-month labor strike and lockout in California that ended in March.

Energy Dept. fails to meet Yucca Mountain deadline

WASHINGTON (CBS.MW) -- The opening of the nation's first nuclear waste site could be delayed again after a government agency ruled Tuesday that the Energy Department failed to meet a self-imposed deadline about public disclosure of all pertinent documents. A licensing board at the Nuclear Regulatory Commission ruled that the Energy Department and the NRC had failed to post all documents on a public website as required six months ahead of formally submitting its licensing application to open a nuclear waste depository at Yucca Mountain, Nev. The government had certified on June 30 that all documents had been disclosed, but Nevada successfully objected to that certification. "It is clear that the Yucca Mountain Project is flawed both in its science and in its management and should be abandoned," said Wenonah Hauter of Public Citizen, a critic of the project.
