BS. I can enter the same type of agreement and list a property as an asset. Why? Because I purchased it, regardless of the terms. That's what co-tennancy is all about. It give the seller rights of recovery if payments are not made as agreed and gives the buyer rights to do with the property as they see fit.

Now as for the bank papers, how do you know for a 100% fact that the note has not been satisfied? You don't. Deeds can take on many holders of interest. All that means is that before a deed is transferred or released to another party, all financial obligations are met. Now where is your proof that CDIV is not meeting their financial obligation? Thought so, you don't.
