I agree. The question that will determine any civil suit activity will be the size of the pot of gold at the end of the court-house steps.

The esquires must foot all costs of a class-action, so they obviously want as air-tight a case as possible. But, even with an almost iron-clad win in the offing, the size of the pot at the end of the rainbow rules in making the final decision to civil or not to civil.

That question will only be answered as culpability is determined and then discovery of greenbacks of the perps is undertaken and accomplished.

The esquires are pouring over facts at this very moment, and I dare say, reading a whole lot of posts (they would be especially thankful for Scion), chatting with the SEC and the feds and the cops and gathering as many little acorns as they can.
