I thought a fact was a fact? Does it depend on what the definition of "is" is?

And IMO, there will never be a courtroom trial. Very few anythings -- criminal, civial, whatever -- ever actually see an actual trial. This is not Perry Mason.

Ordinary, ... The lawyers argue/debate what the facts are. The trier of fact (jury or judge) then makes the determination.

Whatever the trier of fact determines are the facts .....
