I totally agree, the TOU agreement could not be any more clear about the inherent risks involved with the message board service. It is spelled out VERY clear in black and white, and sometimes in red. Anyone that doesn't read it before agreeing to it has nobody to blame but themselves.
Also, there is usually a reason why OTC stocks (pennies and pinky's) are trading in pennies, or fractions of pennies. It is most definitely not an arena that anyone should get involved in without first fully looking in to the entire market.
IMO too many people think they can get rich quick buying pennies because they can get so many shares for such a small amount of money. In most cases when their money evaporates the finger pointing soon follows.
Everywhere you go when doing research on these kind of stocks there are huge red flags flying everywhere. Phrases like: "You should not invest in these stocks unless you are prepared to lose all of your money" can be found all over the place.
It's a risky market to put in very simple terms. Based on some of the posts I read on these message boards there are people trading them that clearly do not have the kind of experience it takes to lessen the risk involved.
