I don't think this is how it works

I'm no lawyer, but my understanding is that damages are awarded based upon lost profits of the patent holder (Neomedia) not by the profits of the infringer (Scanbuy).

Don't know who Louis Ventre, Jr is, but his page is very informative in this regard, especially the section "Damages are not the Infringer's Profits"

Court Awarded Damages Icing On Cake Legal Precedent is what is most important. For once legal precedent is set:

1) A monopoly exists until 2016 for the owner of the Barcode Lookup Patent, which makes NeoMedia VERY VALUABLE to a Google, Microsoft, Apple

2) Scanbuy shall be prevented from operating NeoMedia's patent

3) The owner of the patent receives a cut from every barcode click in the US

4) NEOM shareholders shall profit very well

Samsung shall be one of the major driving forces behind public awareness of barcodes through ad campaigns

The barcode ecosystem is an emerging technology, many large handset manufacturers and mobile network operators stand to profit enormously making it easy for NeoMedia to fully bring to market its product, UPC to Online service. Scanbuy shall no longer be a thorn in the side of NeoMedia stealing its IP and thereby taking market share away from NeoMedia.

In 2008 Scanbuy entered into a Global Agreement with Samsung. A Court win for the patent and Scanbuy is finished because it will no longer be able to operate the patent, Scanbuy's entire business model is based on stealing NeoMedia's patent.
