i found this comment very interesting at the bottom of that article

" Even if Genius wins this lawsuit, they will get sued because the game will resemble Beat Mania and this one is patented already... (in fact somewhere on the Gamasutra stories about this case, it is mentioned that Actvision already stated that to Genius...) "
