The elements of medical malpractice

1. Deviation from accepted medical care within that particular locale

2. Documented harm to the patient.

3. The deviation from accepted medical care caused the patient harm


If the local drug store is out of Latisse, and I wish to use the EXACT same chemical identity (Lumigan) for cosmesis, there is no basis for malpractice, so long as I have given informed consent (explained the indication, benefits and risks - side effects of the medicine to the patient) and DOCUMENTED same on my medical chart.


I have been in the courtroom only once in 26 years years of medical practice, and yes, I was absolved of any malpractice.
