IT APPEARS TO BE OVER!
"WHEREAS, for a variety of reasons, the Debtor and the
Creditors Committee agree that, at this juncture in the case, it is
appropriate that the relief sought by the Debtor in the Exclusivity
Motion be granted without any further hearing thereon, provided
that such relief be without prejudice to any party's rights to make
any arguments for or against any request(s) for any further
extension of the Exclusivity Periods, if any.
NOW, THEREFORE, the parties hereto, by and through their
undersigned counsel, agree and stipulate as follows:
1. The Debtor's Filing Exclusivity Period is extended
from April 10, 2009 through and including April 30, 2009;
2. The Debtor's Solicitation Exclusivity Period is
extended from July 9, 2009 through and including July 29, 2009;
3. The Committee Objection is withdrawn without
prejudice; and
4. The relief sought in the Exclusivity Motion is
appropriate and should be granted without a further hearing"
