If you were a looking at a potential partner with another company would you not make sure one of your conditions of your partnership was that an old law suit be looked after first.
Would you want your investment within the company to go and pay off a judgement.

refernces to Oblimersen(Genasense) 2 from Celgene,1 from Bayer Schering, and 1 from Pfizer INC, who in their invention write a whole paragraph regarding Genasense.
