Sen. Orrin Hatch (R - Utah), the lame-duck chairman of the Senate Judiciary Committee, is pushing to give a lifetime seat on the U.S. Court of Appeals for the D.C. Circuit to a friend whose record makes him unfit for the job.
Thomas Griffith's controversial nomination is set to be brought before the committee by Sen. Hatch on Tuesday, November 16. Contact your U.S. Senators today and urge them to oppose Griffith's confirmation.
Thomas Griffith's record shows that, if confirmed, he would pose a serious threat to the gains our country has made in eradicating discrimination. For example: Griffith has demonstrated opposition to methods to eradicate ongoing gender discrimination. As a commission member considering potential revisions to Title IX, he advocated the elimination of a key test used to measure schools' compliance with the law. His proposal would have made it harder to tell whether schools are discriminating against women and, therefore, would have deprived women of educational and athletic opportunities. Griffith himself called his recommendation "radical" and noted that it "went down in flames," no doubt in part because every federal circuit court that has heard challenges to the test (8 in all) has upheld it. Griffith has shown animosity toward established civil-rights enforcement measures. While on the Title IX commission, he stated that he was "unalterably opposed" to what he called "numeric formulas" that are used to document and remedy discrimination based on race, gender and other factors in a variety of settings. Griffith has knowingly disrespected the law and his profession by practicing law without a license for years. Though he currently serves as general counsel of Brigham Young University, Griffith is not even licensed by the Utah Bar. Griffith has ignored the advice of the Utah Bar to take the Utah Bar exam and complete his license application. It is evident that the rules of law and legal practice which matter most to Griffith are his own. From well-established precedent to the basics of a law license, he appears intent upon rewriting the law to fit his own agenda -- a common trait among Bush's nominees but a terrible one for the judges who are entrusted with protecting Americans' rights.
