A NOBO list is a list obtained from intermediaries containing the names, addresses, e-mail addresses and securities holdings of NOBOs. Access to a NOBO list is not limited to reporting issuers as NI 54-101 also provides that other companies and persons have access to it. However, trafficking NOBO list information is prohibited. The NOBO list is permitted to be used only in connection with: (a) the sending of proxy-related materials to NOBOs in accordance with NI 54-101; (b) an effort to influence the voting of security holders of the reporting issuer; (c) an offer to acquire securities of the reporting issuer; or (d) any other matter relating to the affairs of the reporting issuer. A reporting issuer may continue to use an intermediary to provide shareholder meeting materials directly to NOBOs.
