Good point. Although we haven't seen anything about pricing for Paris/Dublin, so it might not be an issue.
I doubt seriously a processor could pass in 32 bit mode and fail in long mode. Once the instruction is decomposed into uops, it runs on the same hardware. True, it might be possible that there is a defect in the upper parts of one of the registers, but that's going to be pretty rare.
