The only reason I can think of for not filing BK, is because that would bascially end the only chance the pipes and Tony have for being able to sell their shares. Not that they are worth much anyway, but a little money is better than no money and that's all either is left with. Say they get lucky and find someone willing to license a click to call patent, or get a big razrclick PR attempt going with enough volume to drop alot of shares at .01-.02 before finally giving up and going under. Not saying it will happen but it could be what they are hoping for. JMHO
