Based on my personal experience with Judge Patel, I can say it is equally likely that the parties haven't agreed, and the case has dragged on, because the judge has taken an inordinately long time (months and years is not unusual for Patel) to make decisions, and didn't make herself clear when she did finally make up her mind. My firm once had a motion for summary judgment that Judge Patel took under submission for nearly two years before ruling against our client, only to be reversed on appeal a few months later by the 9th Circuit CofA (i.e, promptly).
Just taking advantage of a rare opportunity to provide arguably relevant input here on a subject that happens to be within one of my few areas of expertise!
