The thing that people tend to forget is it doesn't even matter if there was any money that went anywhere. The SEC's claims focused on fraudulent filings and PRs. Even if RPH didn't make a dime, the case still stands. Any recovery for NSS will have to be addressed under a separate lawsuit; it will not and cannot be a part of the present case.
