I could see the 'false and misleading' angle, of announcing a dividend and then not following through; since the company has gone dark, no one knows if any systems have been sold, if so how much money has come back to the corporation, or exactly what the status is....Failing in business, however, is not necessarily illegal, and IPKL is not be the first nano company to announce dividends that never materialize.... If the shell had nothing to sell at the end of the day, there's no reason for SWS to cough up $2.7M for nothing.
It makes for nice PRs, but in the end, I don't know what the SEC is supposed to do about it - send a note to Kanno not to issue 'forward looking statements' anymore?
