I think right now at least for the Florida operations he can get away not having the guy licensed but I doubt he will be able to keep at it forever. Not many big investors would be willing to fund a company that has unlicensed personnel. I think he is also taking a risk if something happens as you say, even if the guy himself was hurt the company would still be liable perhaps.
