Since biopharmaceuticals are not listed in the FDA’s Orange Book, it’s not a simple matter to track exactly which patents apply to a given drug. Thus, compiling a comprehensive list of patent expirations for biopharmaceuticals is partly a subjective exercise that requires making a determination as to which patents are likely to stand up in the event that a regulatory pathway is opened for FDA approval of biogenerics. The same issue applies in other jurisdictions such as the EU.

If anyone does have a trustworthy list of biopharmaceutical patent expirations, please speak up!

Biopharmaceutical Patent Expirations

With the proviso that biopharmaceuticals (other than insulin and hGH, which are regulated as small molecules) are not listed in the FDA’s Orange Book and hence it’s difficult to be sure about which patents apply to a given drug, the recent biogenerics report by Cowen has some tables on the U.S. patent expirations of selected biopharmaceuticals.
