Ragz

That does not even make sense..Are you not following what's up with this.

Sulja did not file a response at all..Airys said this was due to the " wrong name " ( whatever) Sulja's att's asked the court for reconsideration to file a response after the judge said " NO MORE EXTENSIONS "
Drago's att's have asked for the motion to be denied..and have requested a default judgement.

What do you mean " DID SULJA EXTEND THE JUDGEMENT "

so ragz, until the default judgement is rendered, a motion to set aside the default cannot be filed. Once the default judgement is rendered it is by no means over as follow up motions can suspend or even re-open the case from the beginning. No quick relief then for the plaintiffs, at the cost of the defendants untimeliness. Thanks

ragz - wake up!

A motion to set aside the default judgment cannot be filed yet.

Do you know why?

BECAUSE A DEFAULT JUDGMENT HAS NOT BEEN GRANTED BY THE COURT YET..

wake up!

DEFAULT JUDGEMENT

DID SULJA EXTEND THE JUDGEMENT?????

DIRECTIONS FOR FILING
A MOTION TO SET ASIDE A DEFAULT JUDGMENT
Read these directions completely and carefully before filling out
the attached forms.
When someone sues you, that person is called the plaintiff
and you are the defendant. The plaintiff will have you served
with court papers and you will have to file an answer in writing
in the same court where the plaintiff filed the lawsuit. If you
do not file an answer, you will lose by default. The court's
decision against you is called a default judgment. Sometimes, it
is possible to ask the court to reopen your case, that is, you
can ask the court to allow your case to start all over again and
give you another chance to tell your side of the story. You have
to file a motion to set aside the default judgment. The papers
you will need to file are attached. Three of the papers are:
1. Motion to Set Aside a Default Judgment (Form A)
2. Affidavit (Form B)
3. Order (Form C)

I SEE NO REASON THAT THIS MAY HAVE NOT HAVE HAPPENED!!!

WAS AN ABSTRACT FILED?

THIS IS NOT A RECOGNIZED DEFAULT JUDGEMENT!!

WHY??

MOTION TO SET ASIDE A DEFAULT JUDGEMENT HAS NOT BEEN FILED YET!!

USUALLY AN APEAL MAY BE SUBMITTED WITHIN 20 DAY'S. MOTION TO SET ASIDE A DEFAULT JUDGEMENT, WITH EXTENSIONS MAY TAKE 120 DAYS.

THEN YOU START ALL OVER AGAIN.
