brain -- excellent link on constitutional law in wartime -- i had forgotten Norad located deep in a mountain in Colorado, until Rumsfeld mentioned they were having high level planning on how to continue the government in the event of a catastrophic event destroying the Govt in DC -- It appears that civilian authority will be maintained and the Guard and active military plus civil law enforcement personnel would be able to restore/maintain order until duly elected representatives could be installed. -- I have no idea what Franks said or in what context he stated his views -- I do know that every effort will be made by the BushBashers to turn whatever he said into hatespeech -- thanks for the link
