While also correcting another statement, as after receiving a whistleblower tip, the SEC frequently refers cases to the DOJ or FBI to pursue criminal charges. Because the SEC is a civil agency with no authority to put individuals in prison, it regularly collaborates with criminal prosecutors to address deliberate and egregious securities fraud.
The SEC and the DOJ can investigate the same conduct at the same time. The SEC does not have to pause its civil inquiry just because the FBI or DOJ is running a parallel criminal investigation.
