And why would he need to send $5000 worth of spirits to Tony?

If they had the recipes, one would ASSume they were aware of how the RTD would taste. The first step should have been to acquire the 4 certificates of label approvals (COLA’s) in order to begin producing the drink. That process with the TTB would take around 6 months, but could take longer if someone didn’t know what they were doing.

Regardless, Tony doesn’t own APRU, the shareholders do. The ONLY shares Tony owns are worthless until the owner(s) of the A shares cancel theirs, and a bit more cleaning things up would still be in order.

Also, he can't just use a brand to create an RTD without permission from the brand. In other words, if he wanted to use Captain Morgan rum and mix it with an Apple Rush drink, he would need permission from the Captain Morgan brand.

If that's the scenario, he would be better off contacting the brand. As for Apple Rush, that would be Bob Corr, not Tony. Corr owns the brand via the trademark.
