ITC Investigation Involves SMCI (via Netlist Case)

The U.S. International Trade Commission (ITC) has voted to institute a formal investigation into alleged patent infringement by Samsung, Google, and Super Micro (SMCI) in a complaint filed by Netlist, Inc. (NLST).

Netlist claims Samsung memory products and systems containing them (which includes some products from Google and Super Micro) infringe six Netlist patents, especially on DDR5 and high-bandwidth memory modules.

The ITC will decide whether to grant exclusion and cease-and-desist orders that could bar certain infringing imports into the United States if infringement is found.

If the ITC finds infringement and issues an exclusion order, products containing the infringing memory could be blocked from entering the U.S. market, which could affect the supply chain of OEMs and system vendors that use those components — including SMCI.

🔎 The ITC’s Section 337 process is separate from tariffs in the trade-war sense: it’s about intellectual property enforcement, and the outcome can include import bans for non-licensed, infringing products.
