Reading this again, I see that the ruling was signed by Berman's original trial judge. And I think Berman has actually irked him here somewhat. Maybe its my imagination, but I think this might be a bit of the 'bite' that has resulted from Berman's remorseless 'pulling of the tiger's tail' while the case was proceeding and he was still at large... I actually expected this 'modification of payment terms' to go through on the nod, as Keith is clearly old, in ill health and basically indigent. Who would really begrudge an incarcerated white collar non violent criminal in those circumstances the means to afford his own anti-perspirant and toothpaste, priced at a considerable mark up, without being forced to sweat shop it out at slave wages in order to cover the extortionately marked up pricing being offered on a 'take it or leave it' basis? Personally I wouldn't. (But I suspect Berman himself probably would have!...so) And I think this ruling might be a case of "careful what you ask for". This judge was well acquainted with Berman's pre-trial shenanigans and seems to have viewed this restitution appeal -for what I would see as access to basic human dignity - in the same light as those shenanigans. While the beneficiaries of Berman's restitution may only be yielding peppercorn sums that will in no way compensate them for the actual financial losses they endured as a result of his profligacy with OPM, they can at least now console themselves with the thought that the privations and work that Berman - an old sick man - must endure in order to make those small payments far exceeds the effort that he expended while perpetrating his scams. This really is rock bottom. Berman's victims may have lost their pensions, but it seems that as a result Berman is basically reduced to begging, pleading and working hours, for buttons, just to be allowed the privelege of using soft toilet tissue. And the entirety of the legal system that he contorted and used to try and escape the consequences of his actions is now ranged against him in a Kafkaesque fashion to ensure that this will remain the case for the immediately foreseeable.
Berman has really dug himself into a hole here! He can't even rely on the charity of fellow men to haul him up! Talk about hubris!!!!
