Berman has until 21 Jan to respond in his personal capacity as defendant.
As regards to DECN as a corporate entity - default judgement looks pretty inevitable:
The incarcerated Berman doesn't have the funds to buy his own soft toilet tissue! (and is presumably being forced to use prison issue sandpaper ass-wipe at present!)
So I don't imagine that paying for corporate counsel for DECN to defend this SEC action is going to make it up into his Maslow 'needs hierarchy' pro tem.
And as a corporate, DECN cannot elect to defend the action 'pro-se' (i.e. self representation). So without legal representation a default judgement against DECN is almost a fait-accompli.
Berman could elect to defend himself 'pro-se' to get himself a day out in the fresh air.
But the criminal bar has been passed. The civil case against him is a slam dunk.
So I don't see there is much to be accomplished. He would just be turning up to wave, say sorry, and take his medicine.
And there is always the unappealing possibility of some of his victims turning up to wave back!
