While I agree with your analogy, nothing surprises me anymore. After the Lamerth verdict, we still didn't receive justice. Laws & rulings don't seem to apply here.

No one is claiming UST needs to act unilaterally in order to initiate an SPS conversion.  It can be done bilaterally just like every prior amendment to the SPSA.  There is no prohibition against such an amendment in any statute or at common law.
