There are SIX Defendents named in that suite... It looks to me TenKay is correct as they have attached to the order "to set deadlines". That would indicate the case is NOT dismissed.
For those that understand how this works…having HUMBL and Sharp removed from the case is not unusual. The remaining four were officers/directors of the company.
And frankly the parties who should bear responsibility for the result…which is gong to impact the company regardless.
