As i understand it, seems absolutely clear, if there had been a shutdown none of the adverse judicial decisions happening now could have occurred as the appeals wouldn't have been seen as essential.

The courts continue business as usual during a government shutdown.

U.S. courts should continue to hear and decide cases without interruption. Thus, all cases including civil and criminal, old and new should be processed and argued, and judgments should be issued and enforced, according to normal schedules and priorities.
