I think that is certainly on the table. Every dollar that Treasury allows the legacy common to get is one dollar less in their pocket.
Even Ackman's own presentation has the commons going all the way to zero if the seniors are converted. It wouldn't take much tweaking to give them a couple bucks per share and avoid a total wipeout, thus making all the threatened lawsuits much harder to win.
If so, it's best to sell all right before they make the decision and when the market price is probably $10 per share
