While the statement made by Rosen is true, it is also misleading. The misleading portion is contained in the word "held." Here's why. Safe Harbor Assets are held in a Trust. When assets are placed in a Trust ownership is turned over to the Trustee. The prior owner becomes a beneficiary of the Trust. Hence, they no longer "hold/own" the assets.
