Dennis M (OF ALL PEOPLE) should know that he shouldn't come back and sign a contract until the company has fixed the financial situation. It is certainly a waste of time asking for a retainer when the company doesn't have the money to pay him.
I'm surprised. he'll just have to wait, like the rest of the employees. This shouldn't be a surprise to him. Nor a problem.
